The foreclosure process in Washington State relies on out of court and in-court proceedings when carrying out foreclosures. When the deed does not have a sale clause, judicial or in court proceedings are used. In this case, the court is supposed to issue an order to the bank to effect the foreclosure. This means that without a ruling from the court, they cannot proceed with sale of the foreclosed property. It is only after obtaining this that the lender is given authority to sell the property and hence, collect what they are owed from the sale.
The most popular mode of foreclosure is non judicial and this is because it gives the lender the opportunity to same not only on time but money as well. The banks interest is to spend as little money and time on the process as possible and consequently, more often than not, they prefer to use this method. There are a couple of things that need to be followed through and some of these are as highlighted below.
For starters, the lender must send a sale notice letter to the existing home owner. This should be done through certified and regular mail. They should also request for a return receipt. This should always be sent to the last known home owners address. The home owner’s record of attorney should also receive this notice. The time frame set for this notice to be sent is at least a minimal 30 days before sale of the property. Also, the foreclosure process in Washington State also requires that the sheriff be information about the move in advance. This is important as it gives the sheriff the opportunity to have it published or advertised in the notice of the week. This should be done once each week for 4 weeks till the sale date.
